A man was charged with six counts of assault on a peace officer after allegedly attempting to flee from police in a vehicle and accelerating toward an officer during a pursuit through Dededo, according to a magistrate complaint filed in the Superior Court of Guam.
The incident occurred at about 3:42 a.m. Oct. 25, when Guam Police Department officers responded to Tenorio Lane in Dededo for a reported vehicle crash involving an object.
According to the complaint, officers found the driver of a Mazda 3 asleep in the driver's seat with his head down. When officers woke him, he allegedly refused to follow instructions to place the vehicle in park and instead accelerated.
The complaint identifies the driver as Zakiy Powell, 33. As he accelerated, the Mazda allegedly struck a GTA telephone box before continuing toward Donna Lane and then Christina Lane, despite officers' instructions to stop.
Officers pursued the vehicle, which continued along Christina Lane before stopping. The complaint states that the Mazda then fled again, turned east onto Lada Avenue and eventually entered Palm Court, where officers positioned their patrol vehicles to block its exit.
According to the complaint, Powell made a U-turn on Palm Court and stopped with the Mazda facing the patrol vehicles. An officer exited a patrol vehicle and allegedly saw the Mazda accelerate toward him.
The officer drew his service weapon and held it in the low-ready position while shouting instructions for the driver to stop, according to the complaint. The Mazda then stopped.
Officers approached the vehicle and broke the driver's-side window as the Mazda allegedly continued moving forward, nearly colliding with a patrol vehicle before coming to a complete stop.
The complaint states that one officer broke the driver front door window, while another officer reached through the driver's-side window, unlocked the door and placed the vehicle in park.
Powell allegedly resisted officers but was removed from the vehicle and handcuffed, according to the complaint.
Officers reported that Powell smelled of alcohol. When asked whether he had been drinking, he allegedly remained silent.
The complaint identifies six officers as victims in the alleged attempt to strike them with the vehicle.
Powell was charged with six counts of third-degree felony assault on a peace officer, with a special allegation of use of a deadly weapon in the commission of a felony attached to each count. He was also charged with misdemeanor resisting arrest and eluding a police officer.
