The Guam Department of Labor is reminding employers that new workplace signage tied to the Pregnant Workers Fairness Act Rules and Regulations must be displayed within 90 days of enactment.

The law, recently signed into public law, requires employers with 15 or more employees to provide reasonable accommodations for pregnancy, childbirth and related medical conditions, unless doing so would cause undue hardship.

Under the rules, employers must post a visible PWFA notice of compliance in accordance with 17 GAR § 6203. The posting must use a format designed and approved by GDOL’s Fair Employment Practice Division and be placed in a conspicuous location within the workplace.

GDOL inspectors may conduct site visits to verify compliance. Full enforcement begins May 28, 2026, and employers who fail to comply may face civil penalties.

The law also establishes timelines and procedures for filing and investigating complaints, authorizes GDOL to request information and inspect worksites, and outlines fines, mandatory training requirements and an appeals process for contested citations.

“The purpose of this new signage and law is to bring awareness to pregnant workers about policies in the workplace,” said Acting GDOL Director Gerard Toves. “GDOL is committed to make sure workers’ rights are enforced and that there is a way for employees to request reasonable accommodations when needed so they can maintain their health, safety, and livelihoods while continuing to contribute to the workplace.”
