Two men are facing charges of manslaughter after the man they allegedly "smack-attacked" succumbed to injuries according to the complaint filed in the Superior Court of Guam on Friday.

The victim identified in court documents as Herman Koto was initially found lying on a couch outside a residence on Swamp Rd. in Dededo on Oct. 13.

According to the complaint Guam Fired Department medics who first responded to the scene noted Koto was unconscious and had a "weak pulse." Koto was transported to Guam Regional Medical City where he was pronounced deceased despite CPR efforts.

Police who were called to the hospital recorded dried blood around Koto's mouth, mustache and chin. Swelling to the right side of his face, bruising around his right eye, a one-inch laceration on the back of his head, a laceration on his left elbow and swelling on his left hand.

The complaint said that the police investigation involved multiple witnesses and individuals who "knew or who were in recent contact with the victim."

One witness told police that on Oct. 12, Jerald Edward Santos "confronted the victim outside her residence." She alleged that Jerald yelled at the victim about bringing "stolen property" to the residence and "physically assaulted" Koto.

"Jerald poured water on the victim to wake him up. She and others including Jerald and Jerome, later identified as Jerome Edwin Santos ... all gathered at Jerald's residence. While there, Jerald boastfully admitted that he and Jerome had 'slapped around' and 'smack-attacked' the victim," the allegations in the complaint state.

According to the complaint a pending warrant of arrest was active for Jerome for prior cases including assault, aggravated assault and terrorizing.

On Oct. 29, both men were brought into the precinct for interview and allegedly waived their Miranda Rights and spoke with police.

Jerome allegedly told police that on the day in question he and Jerald confronted Koto over a vehicle given to his relative.

"Victim had taken the car from a disabled person that the Victim cared for and that the Victim knew it was stolen. He stated that he slapped the Victim with both hands to both sides of his face, knocking him to the ground and stating '(Explicit) you for putting my life at stake,'" the complaint said.

Police said Jerome "admitted to being in a rage."

"He then walked back over to the Victim while he was on the ground and slapped him twice. Jerome stated that he did not see Jerald strike the victim because at that point his back was turned," the complaint states.

Jerome and Jerald were charged with manslaughter as a first-degree felony and aggravated assault as a second-degree felony.
