A man being detained on $7,000 cash bail allegedly told authorities he is part of an organized burglary ring consisting of about 10 individuals who targeted homes in Dededo, Yigo and Tamuning, according to a magistrate complaint.
The complaint against Kurt Anderson Damian, 46, stems from a theft of property and a separate burglary report filed with the Guam Police Department on Oct. 29.
“According to the Victim 1's garage surveillance camera, Damian enters the garage, retrieves a red gas container and then leaves the garage. After, Damian momentarily remains out of view from the camera. However, Damian returns to the garage and takes a torque wrench, drill bit sets, one torque wrench and one screw tip set,” the complaint states.
The same day, a burglary was reported at another residence where the family had left a back entrance to the home unlocked before leaving. The complaint alleges that several items were missing, including an iPad, passports, designer bags, camera equipment, an Omega watch and a jewelry box. The value of the items is estimated at $14,370.
During the investigation into the burglary, authorities learned that credit cards stolen during the Oct. 29 incident were being used at different locations, including “Sasha Massage, Guam Home Center, Top Shoppe and E Buy.”
The complaint states that the victim in the burglary case visited one of the establishments where the stolen bank cards were used and obtained photos and surveillance footage of the suspects.
“Officers identified that the two individuals from the photo as Kevin John Certeza Roberts and Damian,” the complaint states. “Later, officers confirmed that Kevin and Damian were also the same individuals who used the Victim 3's bank cards at two separate locations namely Top Shoppe and Sasha Massage.”
The complaint alleges that $440 was spent at Sasha Massage and $738.48 at Top Shoppe.
Authorities subsequently issued an all-points bulletin for Roberts and Damian, who were last seen at Top Shoppe with an “unknown” woman. They were reportedly operating a dark gray Toyota Camry with temporary plates and a dent on the right rear fender.
The complaint states that a list of “suspicious” transactions at 38 different locations totaled $3,627.02, with four transactions still pending.
Police said on Nov. 4 that they had “positively” identified Damian on surveillance footage from Kmart. According to the complaint, Kmart's loss prevention officer called police after one of the suspects was seen at the location.
“Upon arrival, officers observed Damian and a female individual named Naomi Sablan, inside Kmart's Cosmetic Department area. Officers then confronted Damian. After the officers informed Damian of the nature of their presence, they placed him in hand restraints and advised him of his Miranda Rights,” the complaint states.
While detained by police, Damian allegedly provided information about the “organization he works with.”
“The organization operates at a duplex across the Villa Rosario Condo in Dededo, which is owned by Bruno Simmons and a female named Jules. The group consists of more than ten people. Everyday, the group drives around Dededo, Yigo and Tamuning area looking for houses to burglarize,” the complaint states.
According to police, Damian said that after breaking into homes, the stolen items are dropped off at the duplex.
“They either keep the stolen items or swap the items for drugs,” the complaint states.
Damian also allegedly admitted to his involvement in the Oct. 29 home burglary.
“Damian admitted that he drove Bruno and another individual named Jay Palau to a Tamuning residence. Bruno and Jay exited the vehicle and walked towards the rear side of the residence. Damian drove back out and waited for about ten minutes,” the complaint states.
Damian allegedly confirmed that the items stolen from the home, including purses and an iPad, were dropped off at the Dededo duplex.
When asked if he was involved in other burglaries, Damian allegedly responded, “There's more, you have to take me, we do this every day, I'm just the driver, some of the stolen items and receipts of some of the purchases he made is inside the vehicle.”
Two receipts were also found on Damian's person. The complaint alleges that he admitted to using two different credit cards to purchase hygiene items and clothing at Kmart.
The complaint notes that Damian is on pretrial release in a criminal case involving similar burglary and theft of property offenses, in addition to theft of a motor vehicle.
In the new case, Damian has been charged with burglary and conspiracy to commit burglary, both second-degree felonies; fraudulent use of a credit card and conspiracy to commit theft of property, both third-degree felonies; and misdemeanor theft of property, criminal trespass and possession of a vehicle without proper identification.
He was placed on $7,000 cash bail. If convicted, he faces up to 63 years of incarceration.
It is important to note that although the complaint implicates several individuals, only Damian has been charged in this case.
