A man identified as Ksam Sam, 19, was held on $3,000 cash bail after being charged with aggravated assault and assault, according to a magistrate report filed Sunday, Nov. 2, before Magistrate Judge Jonathan Quan.
The report, docketed under case CF0772-25, lists Assistant Attorney General Lyle Stamps as the prosecutor in the case. Sam’s immigration status was noted as “unknown.” The court ordered the defendant committed pending further proceedings.
The allegations stem from an incident on Oct. 31, as a woman and her minor siblings identified as "victims" were walking home after trick or treating in Merizo. The affidavit of probable cause states Sam attempted to "run over" the woman and then called her minor brothers out to fight allegedly telling the victim's "Wait for him up the hill."
When the victims reached the intersection of South and North Doyle Streets, Sam along with two other male adults who were not charged in the complaint allegedly attacked the minors who were 16 and 17-years old. "All three adults attacked victim 2, all of whom were punching and/or kicking each other and two more minor aged male relatives of victim 2 joined the fight," the complaint states.
Sunday’s magistrate hearings also included cases involving several other defendants, including Cheyanne Marie Aflague Mattocks, charged with family violence, criminal mischief, and assault, and Viola Rose Tainatongo, charged with terrorizing. Mattocks was held on $1,000 cash bail, while Tainatongo was released on personal recognizance.
The hearing was part of a series of weekend arraignments and bail determinations handled at the Superior Court of Guam. All defendants are presumed innocent until proven guilty.
