A 35-year-old man has been charged with second-degree felony retail theft after allegedly stealing more than $1,500 worth of merchandise from a Home Depot store in August, according to an affidavit of probable cause filed Tuesday in Superior Court.
Prosecutors allege that Cody Edward Cruz, 35, entered the Home Depot store on Aug. 21, 2025, at about 2:32 p.m. Surveillance footage reportedly shows Cruz entering through the Pro-Lumber entrance and removing a Milwaukee-brand laser level from Aisle 16, Bay 8, along with other merchandise totaling $1,509.40. He was later seen on video passing all points of sale with a shopping cart full of items and exiting the store at about 3:54 p.m., authorities stated.
Video footage also allegedly captured Cruz loading the merchandise into a gray Toyota 4Runner parked near the Pro-Lumber exit. Guam Police Department officers interviewed Cruz on Feb. 16 while he was being held at the Department of Corrections. After being advised of his constitutional rights and informed of the evidence against him, Cruz apologized for his behavior, according to the affidavit. He later signed a voluntary statement admitting he took the items without paying and intended to deprive the store of its merchandise.
Cruz was arrested at about 9 a.m. Feb. 16. Court documents state he was on pretrial release in a separate case, CF0842-24, at the time of his arrest. He is charged with retail theft as a second-degree felony and with committing a felony while on felony release.
