A man was arrested after allegedly pointing what appeared to be a rifle at a vehicle carrying a woman and two children near Astumbo Elementary School, according to an affidavit of probable cause filed in the Superior Court of Guam.
Prosecutors allege the incident occurred about 3:07 p.m. Feb. 13, when the woman left the school with two children in a dark gray Nissan Frontier. While driving along Chalan Hachon near Chalan Sibukao, one of the children screamed that a man was trying to shoot at them.
The children told investigators they saw a man holding what appeared to be a black rifle and pointing it toward the vehicle. One child reported hearing a “ping” sound as the vehicle turned onto another road. The woman told police she also heard a similar noise and feared for their safety, though she did not see the suspect.
Guam Police Department dispatch later received a report of a man walking near the school holding what appeared to be a rifle. Officers responding to the area spotted a man matching the description walking toward Quezon Street near Finageyan Elementary School.
According to the affidavit, an officer exited his patrol vehicle, drew his service weapon and ordered the suspect to drop the firearm. The man immediately complied and was detained without incident.
Police determined the weapon was a dual pellet/BB rifle with one pellet chambered. Officers also reported detecting a strong odor of alcohol, red and glossy eyes and slurred speech, leading them to believe the suspect was intoxicated.
The man, identified as Herwin Ron, was arrested at about 5 p.m. Feb. 13.
Prosecutors charged Ron with aggravated assault as a third-degree felony, reckless conduct, child abuse and criminal mischief as misdemeanors.
A magistrate’s complaint contains allegations that have not been proven in court. The defendant is presumed innocent unless and until proven guilty.
